The International Security Council Resolutions between Justice and selectivity

- Abstract –
This thesis through its chapters aims at tackling the resolutions of the international security council concerning the second and third Gulf crisis, issued concerning Iraq, then analyzing these resolutions from the legal, economical and political aspects, then pointing to the reasons that lolled to deal with the gulf crisis differently from other international and regional conflicts and problems, pointing to the duality of standards in the International treatment from the part of the United sates of America, and the United Nation, explaining how this treatment was subject to the logic of policeman and economical interests and not to the logic of the International on the structure of the international law.
This thesis will turn to explain the embedded reasons behind giving the resolutions of the security council concerning the Gulf crisis this power speed, and commitment, in the meanwhile there were resolutions that issued many decades ago, never received the same, Interest and follow-up.
This thesis as was divided in to five main chapters, the introductory chapter tackled the main and formative aspects of the thesis. Then manifesting the theses introduction, determining the thesis problem, and its importance, then as set of questions were asked, which formed the main axis to the research process, answering these questions led to building the reference and legal perspective to the resolutely the reference and legal perspective to the resolutions Issued and the background on which those resolutions were built, which support the hypothesis implied in the thesis relying an the idea that the resolutions of the United Nation and legislative council contained the duality standards concerning issuing and supporting them according to seventh section which gives these resolutions the state as legal commitment in implementation, since they were legally adopted under that chapter in order to intervene through them in repeating the influence in the existing International law in the Arab Gulf region, since this region has its Influence in the International policy, and its Influence in the process of Industrial and technological structure, because it contains the richest oil resources and natural gas in the world, and this serves Interests concerning the closeness to Israel and to the region then the first chapter Gove quick glance a bout the collective security system, and how it evolved, and maintenance the collective security system through the International security council, which adopted the refusal of threatening in using force , or using the force And the collective reaction, concerning using the force against the aggressive country, the collective security representing an open system in front of all countries and it is not directed against one country or a set of countries.
Also included the self requirements of the collective security, and the Objectivity, also this chapter tackled the specifications of the collective security system that characterized by being an International coalition of powers in the face of the resources of possible attack, and it is not directed against countries, but against aggression and the cooperation is the origin in the International relations, and the conflict is the exception.
Also including an evaluation of the collective security, according to the second chapter, it deals with the Security Council, its formulation, committees, and the work process, also the procedures and the voting system, this chapter also deals with the specialties of this council in maintaining the International peace and security and the restrictions answering these specialties.
Then the third chapter gave perspective to the historical background to the Quite Iraqi conflict, and the reasons that led to this conflict The fourth chapter tackled the analysis as some of the security council resolutions concerning the Iraqi case, showing the basis on witch these reslouxzions were established, the extend of neutralization and fairness in those resolutions, and at the end as the thesis results and recommendations were discuses.
